what the heck is a

“special session” ?

Lawmakers in New Mexico usually pass laws only in the winter, during their regular 30- or 60-day session that starts in January. However, the NM Governor can call state legislators to Santa Fe for a special session to address an issue needing special attention or urgency.

Governor Michelle Lujan Grisham called for this special session to begin on July 18th, 2024 to address Public Safety, but the bills she proposes would NOT bring about public safety. They would only harm our communities.

These proposed bills aren’t tough on crime, they’re tough on people.

CRIMINAL COMPETENCY

If passed, a judge would need to tell the local district attorney to consider beginning the process for forced hospitalization, if someone is found “incompetent”. People previously or currently charged with serious crimes, gun-related offenses, or who have been found “incompetent” twice in the last year would automatically be held in a secure mental health facility for up to a week while the court prepares for a longer commitment process.

This bill creates harm

not community safety

CIVIL COMMITMENT BILL

If passed, this will expand the definition of “harm to self” and “harm to others” as criteria for civil commitment aka forced hospitalization!

This bill lacks ethical, legal, or scientific support.

HARSHER PENALTIES FOR PEOPLE CONVICTED OF FELONIES

If passed, it increases the penalty for people convicted of felonies in possession of a firearm from three years to a mandatory nine years. For those with a previous felony conviction for a “serious” violent offense, the sentence would be raised from six years to twelve years.

This bill is excessive and cruel.

ROADWAY ”SAFETY” BILL

If passed, it will prohibit pedestrians from occupying medians less than 3 feet wide on roads with a speed limit of 30 mph or more. The violation is a petty misdemeanor resulting in a fine up to $500 and/or six months in jail.

This bill targets panhandlers and criminalizes poverty.
